A federal appeals court just made it significantly harder for investors to sue Filana Therapeutics as a group. On October 16, 2026, the U.S. Court of Appeals for the Fifth Circuit vacated the class certification order that had been granted by the U.S. District Court for the Western District of Texas in the securities class action pending against Filana Therapeutics and certain of its named officers and employees. Without class certification, plaintiffs cannot pursue the case as a coordinated group, which typically collapses the practical and financial logic of continuing litigation.

The ruling matters beyond the courtroom because Filana, formerly Cassava Sciences, is at a delicate moment in its clinical rebuild. The FDA lifted the clinical hold on the company’s IND for simufilam just last month, clearing the path for a Phase 2a proof-of-concept study in Tuberous Sclerosis Complex-related epilepsy. Carrying an active, certified class action into that study would have shadowed enrollment conversations and complicated any future partnership or financing discussions. The Fifth Circuit’s decision removes that specific overhang, at least in its current form.

Decertification does not end the underlying litigation. The original plaintiffs can seek recertification on a narrower theory, pursue the case individually, or attempt further appeal. The Fifth Circuit’s reasoning, which the 8-K does not detail, will shape what any revised certification attempt looks like. For now, the practical burden shifts back to plaintiffs to reconstruct a viable collective path forward, a high bar after a circuit-level rejection.

What the company can do with the cleared clinical program is the more consequential near-term question. Simufilam is an oral small molecule with no approved version yet, and the Phase 2a study has yet to enroll. Watch whether Filana files an IND amendment or posts a ClinicalTrials.gov update in the weeks ahead: that will confirm whether the FDA hold lift has translated into an active site start.
